This Acceptable Use Policy governs the usage of ClintHost
products and services. This policy is incorporated by
reference into each contract ClintHost
enters into with a customer for the use of such services.
ClintHost
reserves the right to modify this Policy at any time
without notice.
The purpose of this policy is to enhance the quality
of services and to protect ClintHost's
customers from illegal, irresponsible, or disruptive
Internet activities.
- Prohibited Uses:
A. Users do not allow:
- Utilize the service to send mass unsolicited
e-mail to third parties.
- Utilize the service to distribute software
or multimedia products.
B. Utilize the service in connection with any illegal
activity. Users do not allow:
- Utilize the service to copy material from
third parties without proper authorization;
- Utilize the service to misappropriate or infringe
the patents, copyrights, trademarks or other
intellectual property rights of any third party;
- Utilize the service to traffic in illegal
drugs, illegal gambling, obscene materials or
other products or services that are prohibited
under applicable law;
- Utilize the service in any manner that violates
applicable law.
C. Utilize the service in connection with any tortious
or actionable activity. Users may not:
- Utilize the service to publish or disseminate
informaiton that
i) constitutes slander, libel or defamation,
ii) publicizes adult contents or warez sites,
iii) publicizes the personal information or
likeness of a person without that person's consent
or
iv) otherwise violate the privacy rights of
any person.
- Utilize the service to threaten persons with
bodily harm, to make harassing or abusive statements
or messages, or to solicit the performance of
acts or servicse that are illegal under applicable
law.
D. Utilize the service in connection with any other
disruptive or abusive activity. Users may not:
- Utilize the service to undermine or cause
harm to a server or customer of ClintHost;
- Use programs that consume excessive CPU time
or storage space;
- Allow the use of mail services, mail forwarding
capabilities, or autoresponders other than for
the customer's own account;
- Resell disk space without an appropriate reseller
agreement;
- Resell or provide remote access to CGI scripts
installed on ClintHost
servers;
- Operate IRC servers or IRC bots from ClintHost
servers.
- Account Policies and Cancellations:
We do not require an advance notice to cancel your
service. Although there are no cancellation fees,
all
fees paid for the service up to the notice of cancellation
are non-refundable. If cancellation is made within
the first 30 days of service, all hosting fees will
be refunded. This does not include fees for domain
registration.
Accounts are payable in full at the time the account
is created. If payment by check or money order is
selected, payment must be received within two (2)
weeks of account activation or the account will
be suspended without further notice to the customer.
New accounts that remain past due for thirty (30)
days after account activation are subject to termination.
Any account reaching thirty (30) days past due is
subject to suspension for nonpayment. Such accounts
are subject to termination after forty-five (45)
days in the past due state.
- Suspension:
Activity which results in a suspension or deactivation
of an account will result in a forfeiture of fees
paid. Complaints made regarding abuses of an account
will be grounds for suspension.
- Refusal of Service:
We reserve the right to refuse, cancel, or suspend
service at our sole discretion. Please direct any
violations of the above policies to abuse@clinthost.com.
Failure to follow any terms or conditions will be
grounds for immediate account deactivation.
- Reservation of Rights:
ClintHost
reserves the right to cooperate with appropriate
legal authorities in investigations of claims of
illegal activity involving ClintHost's
services, customers and other users. ClintHost
reserves all other rights to respond to violations
of this policy to the extent of applicable law and
in accordance with any applicable contractual obligations. ClintHost assumes no responsibility for lost wages, lost income, damages or any of the similar due to downtime or any other reasons.
